Massachusetts has introduced a new option to address housing needs. Thanks to legislation signed by Governor Healey, single-family homeowners can now create rental apartments in their homes or on their property. This initiative reflects the Healey-Driscoll administration’s commitment to increasing housing production and improving access to affordable living options for families.

An Accessory Dwelling Unit (ADU) is a secondary living space on the same property as a single-family home. ADUs offer flexible housing options, addressing affordability and availability. They can be:

  • Internal: Conversions within an existing home, like basements.
  • Attached: Additions to the primary residence.
  • Detached: Standalone units, such as cottages or garages.

Under the Affordable Homes Act, signed by Governor Healey on August 6, 2024, ADUs up to 900 square feet can now be built by right in single-family zones, streamlining approvals and reducing barriers.

This legislation reflects Massachusetts’ leadership in tackling housing costs with innovative, scalable solutions. ADUs provide homeowners flexibility while helping communities expand housing supply responsibly.

Key Requirements:

  • Separate entrance for safe egress.
  • Size: Up to 900 sq. ft. or half the principal home’s size.
